INSIGHT: GAO Reminds Pentagon: Use of OTAs Not Unfettered

Jonathan D. Shaffer and Todd M. Garland discuss a recent GAO decision sustaining a protest that challenged an award by the Department of Defense under its “other transaction” authority.  Because “other transaction” agreements are not subject to the Competition in Contracting Act’s requirement that agencies use “full and open” competition, protests involving award of the agreements are rare.
