Smith Pachter McWhorter/Association of Corporate Counsel, National Capital Region, Government Contractors Forum presentation on government investigations: July 12, 2017 12-2pm, at SPM Offices

SPM Members John S. Pachter and Iris E. Bennett to lead a panel discussion with Jim Winner, Chief Legal Officer and General Counsel of a new company being formed by MHVC Acquisition Corporation, formerly Harris Corporation’s Government Services business, on Government Investigations and Enforcement – Cooperation, Defense, and Settlement Strategies.

The program, sponsored by the Association of Corporate Counsel, National Capital Region, will discuss issues facing government contractors when confronted with government investigations for criminal or civil fraud – ranging from FCPA to the False Claims Act – and must evaluate carefully how to deal with the government agency or, at times, multiple agencies who may be involved: DOJ, SEC, and suspension and debarment officials. A careful approach to cooperation, defense, and settlement in responding is critical to ensure the most successful outcome possible: one that mitigates both financial and other penalties, such as being required to accept a corporate guilty plea, imposition of a compliance monitor, or suspension and debarment, and that best preserves the company’s reputation in the marketplace. This program will discuss recent cases and highlight key strategies and tips for how to conduct internal investigations to best support the requirements of addressing a government investigation, how to interact with and provide information to the various types of regulatory and enforcement agencies that may become involved, and how to best portray a company’s remediation efforts.
