Representative Cases
Military Family Housing:
Represented contractor in REAs, claims and ASBCA litigation against the U.S. Army Corps of Engineers and Department of the Air Force on multiple contracts for military family housing. Issues included structural engineering problem requiring load testing, joint engagement of testing expert, and negotiation of load test protocol; negotiation and litigation of performance evaluation issues; and multiple contract administration disputes. All matters were successfully resolved through negotiations and settlement in advance of trial.
Hydrant Fueling Systems:
Represented contractor in contract administration issues on Department of Defense hydrant fueling system projects.
Water and Wastewater Construction Project, Egypt:
Represented joint venture/contractor in ICC arbitration against the Government of Egypt and involving the United States Agency for International Development (USAID); issues included contractor claims of differing site conditions, defective design, constructive changes and interpretation of Egyptian law; arbitration conducted in Cairo, Egypt under the auspices of the Cairo Regional Centre for Commercial Arbitration; arbitration panel issued arbitration award in favor of the joint venture/contractor including award of attorney's fees and costs.
Ocean Club Addition and Renovation Project:
Defended construction manager and e+o carrier Lloyd's of London on professional liability claim; successfully resolved through negotiation.
Industrial Process Plant:
Represented contractor in complex disputes growing out of $180,000,000 EPC Contract involving differing site conditions, design scope issues and defense of defective design allegations, as well as bankruptcy insurance issues. Case settled after commencement of AAA arbitration.
Nuclear Facilities:
Preparation and negotiation of contractor's claims on two contracts for nuclear steam generator replacement.
Co-Generation Facility:
Defended EPC Contractor against boiler warranty claims; resolved in mediation.
Earthfill Dam/Reservoir:
Claims for differing site conditions in rockfill and impervious borrow areas on $385 million dollar fixed price contract with local government water district; resolved all disputes in mediation.
Hydropower Plant Construction:
Represented contractor in preparing claim involving defective specifications, concrete mix design in dam construction contract for structural slurry walls; prosecuted in Federal District Court, obtained settlement at conclusion of discovery.
Wastewater Treatment Plant Construction:
Represented contractor in federal court jury trial of differing site condition in contract for wastewater treatment plant construction; Represented contractor in arbitration of claims under wastewater treatment plant construction contract against municipality owner.
University Building Construction:
Represented general contractor in defense of owner's claims for defective design and construction of glass block walls in University laboratory building; resolved all disputes in five-party mediation.
